Today, the Department of Labor (DOL) released a final new rule for association health plans (AHPs). AHPs are group health plans that employer groups and associations offer to provide health coverage for their members’ employees. This new rule will provide additional ways for employers to get health coverage from AHPs.
ECFC will analyze this proposal and provide a more detailed description for our members. In the meantime, we have provided you with the final rule and the White House Fact Sheet on the rule.
This new AHP rule is promulgated pursuant to President Trump’s Executive Order issued in October 2017, which instructed (i) the DOL to consider expanding the current rules regarding AHPs; (ii) Treasury Department, DOL and Department of Health and Human Services (HHS) to consider changes to the rules regarding Health Reimbursement Arrangements (HRAs) and (iii) Treasury, DOL and HHS to consider whether to expand the availability of low cost short-term limited duration insurance. With this final new rule issued, the only directive of this Executive Order which has not yet been addressed is changes to the rules for HRAs; we will update the membership as we become aware of any movement by the agencies on this issue.
