ECFC Submitted Comment Letters to DOL and IRS

Today, ECFC submitted letters to the Department of Labor and to the IRS and Treasury Department on the following issues:
  • Comment letter to the DOL on proposed regulations under the Fair Labor Standards Act to make it clear that HRAs would not be treated as compensation for purposes of the federal minimum wage and overtime laws as is the case for other employer-provided health benefit plans.
  • Letter to the IRS and Treasury requesting they include on the 2019-2020 Priority Guidance Plan regulations regarding the definition of a qualified medical expense under Code section 213 and finalize the regulations for cafeteria plans under Code section 125.
We file these comment letters with the regulatory agencies both to make sure that they know what our priorities are and to make sure that they see ECFC as an important voice on these issues.
